The MYEV Descriptions Buyback Guarantee ("Guarantee") is a limited indemnification program designed to protect subscribing dealers from financial loss caused by Material Inaccuracies in AI-generated vehicle descriptions.
This Guarantee is not a warranty. It is a limited indemnification against documented losses directly caused by factual errors in descriptions generated by our AI system.
This Guarantee is subject to the terms and conditions outlined below and is incorporated by reference into the MYEV Descriptions Terms of Service.
2. Definitions
- "Material Inaccuracy"
- A factual error in AI-generated content regarding vehicle specifications, features, or capabilities that: (a) is objectively verifiable as incorrect; (b) directly caused the buyer's return decision; and (c) would have materially affected a reasonable buyer's purchase decision.
- "Eligible Transaction"
- A retail vehicle sale completed by a subscribing dealer using an unmodified MYEV Descriptions-generated listing during an active paid subscription period.
- "Return/Unwind"
- The rescission of a vehicle sale where the dealer accepts the vehicle back and refunds the buyer's purchase price.
- "Wholesale Value"
- The vehicle's value as determined by Manheim Market Report (MMR) for the specific VIN, adjusted for mileage and condition at the time of return.
- "Claim Period"
- The window of time during which a claim may be submitted, as specified in Section 6.
3. Eligibility Requirements
To be eligible for coverage under this Guarantee, all of the following conditions must be met:
3.1 Subscription Status
- You must have an active, paid subscription at the time of the original sale
- Free trial participants are NOT eligible for Guarantee coverage
- Subscription must remain active through the claim submission date
3.2 Description Requirements
- The listing must have used an MYEV Descriptions-generated description
- The description must NOT have been modified, edited, or supplemented by the dealer
- The description must have been generated from accurate VIN and mileage data provided by the dealer
3.3 Transaction Requirements
- The sale must be a bona fide retail transaction with an unrelated third-party buyer
- The return must be a documented unwind (not a trade-in, exchange, or new transaction)
- The return must be solely due to a Material Inaccuracy in the generated description
4. Coverage & Limits

4.1 Coverage Calculation
If a valid claim is approved, MYEV will reimburse the dealer for documented losses up to the per-vehicle maximum, calculated as:
- The difference between the original sale price and the wholesale value at time of return
- Reasonable, documented costs directly related to the unwind (e.g., title transfer fees)
- Excluding: reconditioning costs, lost profit, opportunity costs, or consequential damages
5. Exclusions
The Guarantee does NOT cover:
- Dealer-Provided Bad Data: Inaccuracies resulting from incorrect VIN, mileage, or condition information provided by the dealer
- Modified Descriptions: Any description that was edited, modified, or supplemented after generation
- Buyer's Remorse: Returns where the buyer simply changed their mind, found a better deal, or returned for reasons unrelated to description accuracy
- Subjective Claims: Disputes over subjective qualities (e.g., "excellent condition," "low mileage relative to age")
- Trial Period: Any transaction conducted during a free trial period
- Mechanical Issues: Vehicle defects, mechanical problems, or conditions not related to the description
- Post-Sale Events: Accidents, damage, or condition changes occurring after the original sale
- Fraud: Transactions involving suspected fraud, misrepresentation, or collusion
- Non-Retail Sales: Wholesale transactions, dealer-to-dealer sales, or auction sales
- Platform Modifications: Changes made to the description by listing platforms (CarGurus, Facebook, etc.)
6. Claims Process
Strict Timelines Apply: Claims submitted outside the specified windows will be automatically denied without exception.
6.1 Timeline Requirements
- Original Sale Window: The vehicle must be returned within 7 calendar days of the original sale date
- Claim Submission: Claims must be submitted within 5 business days of completing the unwind
6.2 How to File a Claim
Document the Issue
Identify the specific Material Inaccuracy in the AI-generated description. Document evidence showing the description was incorrect (e.g., window sticker, manufacturer specs).
Complete the Unwind
Process the vehicle return and buyer refund according to your standard procedures. Retain all documentation.
Submit Claim
Email claims@myev.com with: original listing URL, generated description, proof of inaccuracy, buyer complaint documentation, refund receipt, and wholesale valuation.
Review Process
MYEV will review your claim within 10 business days. We may request additional documentation. You will receive a written determination.
6.3 Required Documentation
- Copy of original listing showing the MYEV-generated description
- Proof the description was used without modification (screenshot of live listing)
- Documentation proving the specific inaccuracy (window sticker, manufacturer specs, Carfax)
- Written buyer complaint referencing the inaccuracy as reason for return
- Proof of completed refund (receipt, wire confirmation)
- MMR or comparable wholesale valuation report
- Dealer certification stating all claim information is accurate
7. Valuation Method
Wholesale value for claim purposes will be determined using:
- Primary: Manheim Market Report (MMR) for the specific VIN as of the return date
- Secondary: If MMR is unavailable, average of Black Book and NADA Clean Wholesale
- Adjustments: Standard mileage and condition adjustments per valuation guide methodologies
MYEV's valuation determination is final and binding.
8. Payment Terms
- Approved claims will be paid within 30 calendar days of final determination
- Payment will be made via ACH transfer to the dealer's bank account on file
- Payment is contingent upon dealer's continued compliance with Terms of Service
- MYEV reserves the right to offset approved claims against outstanding subscription balances
9. Limitations
Sole Remedy: This Guarantee is the exclusive remedy for any claim relating to the accuracy of AI-generated descriptions. By accepting coverage, you waive all other claims and remedies.
9.1 Anti-Fraud Provisions
- All claims require signed dealer certification that information is accurate
- MYEV reserves the right to audit claims and request additional documentation
- Fraudulent claims will result in immediate termination of subscription and Guarantee coverage
- MYEV may pursue legal remedies for fraudulent claims
9.2 Discretionary Coverage
MYEV reserves sole discretion to:
- Approve, deny, or partially approve any claim
- Request additional documentation or investigation
- Modify Guarantee terms with 60 days' notice
- Discontinue the Guarantee program with 90 days' notice
10. Termination
This Guarantee terminates automatically upon:
- Cancellation or non-renewal of your subscription
- Termination of your account for any reason
- Discovery of fraud or material misrepresentation
- Reaching the annual claims limit (3 approved claims)
- Discontinuation of the Guarantee program by MYEV
Pending claims at the time of termination will be processed according to these terms.
